The Ocean Energy Minute: from the Law Offices of Carolyn Elefant

Welcome to an exciting new feature of the Offshore Renewable Energy Law Blog: the Ocean Energy Minute (or more accurately here, 3 minutes). In this video, I offer some additional thoughts on FERC's proposed policy for preliminary permits for wave and tidal development, initial comments on MMS' Programmatic DEIS for renewables on the OCS and some good news on the future of the ocean renewables industry. There is one caveat to the video: FERC has issued a permit in one competitive proceeding (see Snohomish order), relying on the Section 7(a) municipal preference provisions of the FPA. In contrast to the "first to file" rule that I discussed in my video and which is a FERC-created policy, municipal preference is mandated by statute.
